On what legal basis do we rely to collect your personal data?

We process your personal data in accordance with the provisions of the GDPR and of the applicable data protection legislation. The processing of your personal data is justified by the following legal bases:

  • It is necessary for the performance of a contract or for the performance of pre-contractual measures taken at your request. When you contact us, the purpose of processing your personal data arises mainly from that service and we will process your information in order to be able to provide you with the said service, to assist you and to respond to your requests, or to assess whether we can offer you a given product or service, and under which conditions.

Who processes your personal data?

In order to fully deliver the service provided under the subscription you submitted on the Website, two Parties take part in the processing of your personal data:

  • The Club or the Academy, which has chosen to use the Service provided by KEEPER IN MOTION for its own purposes and from which it derives a sporting interest, namely the management of its performance assessment sessions of its Players in a training or match context. The decision to carry out an assessment, and consequently the processing of the data of the Players concerned, is moreover a matter for the sole will and sole responsibility of the Client, KEEPER IN MOTION having no power or control in this respect.
  • KEEPER IN MOTION, which alone designed the Service that it offers in a standardised manner and under its own graphic identity. It also derives an economic interest (direct and/or indirect) from the use of the Service by the Users, and appears as the most direct point of contact, for those Users, regarding questions and complaints relating to the use of the Service.

In this respect, the Parties in question expressly acknowledge that they are both joint controllers of the shared Processing operations, and thus allocate the roles and responsibilities as follows:

  • The Club or the Academy is responsible (i) for securing access to its Client Area in order to limit access to the jointly processed Data to only those persons who actually need to know and use it for the purposes of the shared Processing operations, and, where applicable, (ii) for the compliance of the data of its representatives and employees.
  • KEEPER IN MOTION is responsible for the design and security of the Service, for the selection and coordination of the Sub-processors involved in connection with the Service (including in particular the host of the Application and the Payment Services Provider), for informing the Data Subjects about the shared Processing operations, and for handling the Requests to exercise the rights of the Data Subjects.

That being said, KEEPER IN MOTION and the Club or the Academy agree, under the GDPR Agreement, to designate KEEPER IN MOTION as the priority point of contact of the data subjects for any question or complaint relating to these processing operations

Each Party furthermore undertakes towards the other to implement the shared Processing operations in compliance with the applicable Laws and regulations on the protection of personal data.

The details of the commitments and obligations arising from this joint responsibility for the processing of your personal data required by your subscription are set out in the Joint Controllership Agreement for the Processing of Personal Data established between the aforementioned parties, and may be obtained on simple request at the contact address provided further below in this document.

To whom are we likely to transfer your personal data?

We disclose your personal data only to identified and duly authorised recipients. In particular:

  • Judicial or financial authorities, State agencies or public bodies, upon their request and within the limits of what is permitted by law;
  • Providers supplying services on behalf of KEEPER IN MOTION.

Who are our sub-processor partners?

  • AWS (Germany / Frankfurt)

We also ensure that, for the purposes of the personal data Processing operations concerned, we only engage Sub-processors providing sufficient guarantees to ensure a level of security compliant with the requirements of the GDPR.

How do we store your personal data?

Your personal data will be retained by us and our service providers, in accordance with data protection laws, to the extent necessary to achieve the processing purposes defined in this privacy notice.

How long do we keep your personal data?

Your personal data will be retained for the duration of our relationship (for example until you unsubscribe from our newsletter) and for a maximum period of two years after the end of it. Prospect data and personal data entered in online forms will be retained for two years. For any other data and/or purposes, your personal data is retained only for as long as necessary for the purposes for which it was collected, or for a period required or permitted by the laws in force.

How to exercise your rights over your personal data?

KEEPER IN MOTION wishes to ensure that you are fully aware of your data protection rights. Every user has the following rights:

  • The right of access: at your request, KEEPER IN MOTION will provide you with a copy of the personal data it holds about you. In certain circumstances a reasonable fee may be required for this service.

  • The right to erasure: once you have sent a formal request to close your user account in the application, KEEPER IN MOTION will delete or anonymise all personal data concerning you, subject to the legal provisions in force.
  • The right to restriction of processing: at your request, KEEPER IN MOTION will restrict the processing of your personal data, under the conditions provided for by Article 18 of the GDPR.
  • The right to object to processing: you have the right to object to the processing of your personal data by KEEPER IN MOTION, under the conditions provided for by Article 21 of the GDPR.
  • The right to data portability: at your request, KEEPER IN MOTION will transmit or communicate to another organisation the data you have provided to it, to transfer the data we have collected from another organisation, under the conditions provided for by Article 20 of the GDPR.

We have one month to respond to any request you may make. If necessary, this period may be extended by two months, taking into account the complexity and the number of requests. Where applicable, KEEPER IN MOTION will inform you of this extension and of the reasons for the delay within one month of receipt of the request.

Why do we ask for your age?

The provisions of the GDPR and the exercise of your rights in this area, as well as the applicable general law of contract, in particular with regard to the rules concerning the validity, the formation or the effects of a contract in respect of a child, may lead us to report the steps you take with KEEPER IN MOTION to a legal guardian designated by you.

Indicating your age allows us to determine whether or not the designation of a legal guardian must be requested from you.
